We are at the very beginning with this section as we know already that there are good and bad ‘expert witnesses’ but, more dangerously, that many, if not most, work only for the police and prosecution.
There is general and helpful information at Tired-of-Spam. The publisher documents personal experiences with spyware and research on hijacking and adware/spyware companies. The publisher is also moderator of a help and information forum for victims of spyware attacks at Spywarewarrior.
She says, “People come to us every day in email or in the forum, with sad tales of jobs and marriages endangered, angry accusations of family members, begging for help and understanding. Wives don't understand when the computer is suddenly full of porn files. Neither do bosses. But we do, and we know it's not always the user's fault.”
Forensics expert
In the course of our work with Jack, when we appealed for help we found one UK company prepared to take on Jack’s case on a no win-no fee basis. They were prepared to do forensics analyses of his hard drive in an attempt to establish how the images got there, whether for example they could have come through browser hijack. We cannot take up their kind offer until we get a new US lawyer, which we are still working on. Most people, however, will not have been rendered penniless like Jack, so the first step is to make sure that your defence lawyer has an adequate computer forensics expert. His or her first service to you may be to demonstrate that the ones being used by the police are charlatans.

They claim to be defeating over 75% of the cases brought against individuals in the UK.

We would appreciate hearing from other forensics experts prepared to work for the defence. We prefer not to hear from those who accept lucrative fees acting only for the police and prosecution services.

One of Jack’s most recent contacts has provided advice and information that could be of great assistance to many people in trouble.
Ted Coombs is a computer forensics expert in the US who has responded to Jack’s appeal for assistance. Jack contacted him after seeing his latest contribution to Science.org, titled Defense Forensics and Child Pornography.
Here are some of his key statements:
“Today's operating systems, in particular the Windows operating system, are so insecure that it is impossible to say that any one individual is in control of their computer.
“The number of viruses, worms, spyware, key loggers and other types of computer vulnerabilities is endless.
“There are viruses that plant kiddie porn images on a hard drive and then send e-mail to the computer owner claiming that a program has detected child porn on their computer and here is the proof, showing evidence of what the virus had planted. Claiming that these images are only some of the images that can be found, claims that for a fee (extortion) they (whoever they are) will clean the offending images from the hard drive.”
Editor: This is further corroboration of this new form of extortion racket. Readers should note that the extortionists need a supply of child porn images. The main possessors of legally held child pornography are the police.
“Even with the best efforts of the computer user to eradicate the virus, erasing the browser cache, where temporary copies of the images are stored, the images will still exist in the unallocated sector space of the computer's hard drive. Many, if not most of the images presented as evidence of child porn possession come from the unallocated sectors of hard drives. Unallocated sectors are those portions of the hard drive that once contained files that were erased.
“- - - it has become the responsibility of the accused to prove innocence of possession - - - .
“They (the prosecutors) cannot, beyond a reasonable doubt, claim, in most cases, that the accused downloaded, viewed, or was in any way in control or had knowledge of the images he is accused of possessing.”
