Death penalty for sex acts in Georgia
A bill is going through the Georgia General Assembly to provide for the imposition of the death penalty for the offence of aggravated sodomy when the victim is less than 12 years of age. Where the victim is not less than twelve years of age, and sodomy is used with force and against the will of the other person, it will also be an offence of aggravated sodomy, carrying imprisonment for life or not less than ten nor more than 30 years.
The bill also provides for punishment for the less serious offence of (non- aggravated) sodomy, which is imprisonment for not less than one nor more than 20 years.
Sodomy is defined as where he or she performs or submits to any sexual act involving the sex organs of one person and the mouth or anus of another. Aggravated sodomy is when he or she commits sodomy with force and against the will of the other person or when he or she commits sodomy with a person who is less than twelve years of age. The fact that the person allegedly sodomized is the spouse of a defendant shall not be a defence to a charge of aggravated sodomy.
So a wife claiming that she has been sodomized by her husband against her will could earn him twenty years in prison.
The horrendous nature of this new legislation can be seen in its definition of sodomy. The bill defines the offence of sodomy as ‘when he or she performs or submits to any sexual act involving the sex organs of one person and the mouth or anus of another’ (Code Section 16-6-2 (a) of the Official Code of Georgia Annotated). Let us consider this.
Both fellatio and cunnilingus involve the sex organ of one partner and the mouth of the other. Either partner engaging in these now appears to be criminalized. If both partners engage in this, in the so-called 69 position, both appear to commit sodomy.
A woman sitting upon a man and using her hand to insert his penis into her anus both performs and submits to sodomy. The man in turn performs it.
The thousands of hard core videos and movies displaying fellatio, cunnilingus and penetration of the anus put the performers in danger of imprisonment should they be identified in Georgia.
If a man puts his penis into (and presumably against) the mouth of a girl or boy under twelve, this can earn him the death penalty. If a man puts his penis into or against the anus of a girl or boy under twelve, this can earn him the death penalty. If a woman persuades or allows a girl or boy under twelve to lick her vagina, this can earn her the death penalty. Should a man or woman lick the anus of a girl or boy under twelve, this can earn them the death penalty.

While a bill in the Georgia legislature imposing the death penalty for crimes of pedophilia and rape is not surprising, a new bill criminalizing nonaggravated sodomy between consenting adults would contradict the June 2003 federal
Supreme Court decision in Lawrence & Garner v. State of Texas, which ruled that sodomy laws are unconstitutional and unenforceable. The Lawrence v. Texas verdict received a tremendous amount of media coverage which I'm sure did not escape the notice of Representatives Bearden and Franklin. Why they would introduce a state bill that clearly contradicts a recent federal court decision is curious and disturbing, but probably futile.
