Class action against the infamy of the Operation Ore and similar raids

The scope of the class action. For the moment it seems it will cover the UK and Ireland, although there may be separate actions in each jurisdiction. It now also seems that the class action should extend beyond Operations Ore and Amethyst to all of the damaging accusations, raids and convictions that were based on the false or incompetent evidence of certain police officers and expert witnesses.

Main considerations that could determine the shape and timing of a class action

There are several moves already in play, which could lay the groundwork for a class action. These include complaints and allegations of criminal activity on the part of certain police officers and expert witnesses already submitted to the UK police, two of which have been reluctantly accepted by them for investigation. In addition there are several independent legal actions underway, brought by individuals. There is also the possibility of an appeal to the Human Rights Court in Europe.

A major stumbling block has been the apparent absence of good lawyers willing to take on such an action in the negative climates of the UK and Ireland during these recent times, and, up to very recently when the tide began to turn, a hostile and destructive media. The legal profession is unhappy about the situation, which has been very bad for its image and judges are becoming irritated with the wrangling over ‘forensic evidence’ and discredited expert witnesses. One of the biggest problems is that most of those falsely or unfairly accused have had their lives shattered and are broken in spirit, unable to fight back Fortunately for society, a few have risen to the challenge. What the authorities failed to notice is that this injustice was carried out against a potentially dangerous and powerful enemy – intelligent men and women. The real tragedy for the state is that many of these have now lost all trust in it.

What is required from the action?

A minimum of the reversal of all charges in all cases, the erasure of any records, and to each and every name on the list, or their surviving families, an emergency payment without prejudice to be made as quickly as possible. Some are now facing or are in bankruptcy. This would effect rescue, help alleviate pressures, and the people could then independently take legal action, or join in the class action.

It has been suggested that several newspapers need also to be sued as well as television companies and child advocates, together with 43 police forces in the UK, and a number of agencies. The resulting money could create an organisation to prevent this from ever happening again on any issue.

What is the current situation?

A volunteer, not directly affected by the injustices of the Ore and similar raids, is prepared to act on an honorary basis for the time being to collect names and help prepare the class action for delivery to a competent and interested lawyer.
