Grotesque eleven year sentence

A young man from Douglas County, Georgia has received an 11 year prison sentence for doing what most young men do, or at least used to do. The savage sentence on 19 year old Gernarlo Wilson was made worse by the condition that he not be eligible for parole for 10 of the 11 years. The prosecutor was Assistant District Attorney Eddie Barker. A jury acquitted Wilson of raping a 17-year-old girl, but convicted him of the less serious charge of aggravated child molestation against a 15-year-old girl.

Five other male youths who were with him on the occasion pleaded guilty to child molestation of the 15-year-old and sexual battery of the 17-year- old. We await news of their sentences.

Here however is another version of the story. The six teenage boys and the two girls were all enjoying a 2004 New Year's Eve party at which they were drinking alcohol and smoking marijuana. Wilson was barely 18 at the time and the 17 year old he was found not guilty of raping was just a few months younger than he. The ‘aggravated child
molestation’ was allowing a 15 year old girl to give him oral sex. It is now the crime of ‘receiving oral sex’ from a child.

As for the reason that prosecutor Barker tried also to convict him on the rape charge against the17 year old: "We said that she was too intoxicated to give consent."

Once the 15-year-old girl admitted to the oral sex, there was no hope for Wilson, as under Georgia law, a 15-year-old is considered too young to give legal consent to sexual activity, which was the reason Barker prosecuted.

Elsewhere on this web site we have been warning about the serious dangers for young men in having sexual relationships of any kind with girls of their own age when either or both are under 18. Up to now, while not acceptable, one could understand the reluctance of the citizens of the western world to stand up for their rights and to fight repressive legislation. They were as Gore Vidal says ‘cowed’. They have allowed this repressive legislation through apathy and cowardice and because of the bullying of the child rights and sex abuse activists.

But now our sons are being criminalized and no family with normal boys under 18 is safe. The time for action is long overdue.

A homosexual version

When Matthew Limon had just turned eighteen and was attending the Lakemary Center for people with developmental disabilities in Paola, Kansas, he allowed a 15 year old boy to perform oral sex on him. Both had a mild learning disability and it has never been disputed that the sex act was consensual. Limon was sentenced to seventeen years for a crime that would have earned a heterosexual fifteen months in Kansas. Limon, now 22, appears to have the mental capacity of a twelve year old, but Kansas considers it ‘statutory rape’ whenever a person older than eighteen has sex with someone under the age of sixteen.
Kansas has a 'Romeo and Juliet’ law which asserts that the penalty for statutory rape should be less severe when the case involves two teenagers and one is no more than four years older than the other. It defines ‘unlawful voluntary sexual relations’ as intercourse, sodomy or ‘lewd fondling or touching’. But it allows the 'Romeo and Juliet’ exception only for boy and girl, not boy and boy. Thus Limon received a sentence for criminal sodomy (some US states include male-male oral sex in sodomy). And he is now a lifelong registered sex offender.

Kansas Attorney General Phill Kline has given as one reason for keeping Limon in jail that he is a ‘repeat offender who commits sex offenses against children’. This refers to two prior convictions in juvenile court, both for having sex with people under the age of sixteen. But both ‘crimes’ occurred on the same day when Limon was fourteen, and the authorities will not release details because the so-called victims were also juveniles. As Kline puts it, “Because of his predatory nature towards children, he is considered to be a sex predator in Kansas under Kansas law."
